• Introductory provisions

The purpose of these General Terms and Conditions is to Fluss.hu the rights and obligations of the Consumer who uses the services provided by the Supplier (hereinafter referred to as the "Consumer"). Set out the terms and conditions of registration, cancellation, participation, contract, data management principles for Fluss.hu (hereinafter referred to as the "Service Provider") classes and courses. The GTC apply to all legal transactions and services that the Consumer may use. The Service Provider and the Consumer are hereinafter collectively referred to as the "Parties".

• General information

A www.fluss.hu we sell participation in the Service Provider's classes and courses through the Motibro app on the website.

To register for classes and courses, please contact www.fluss.hu from the website via Motibro, after registration or by personal appointment with the studio's instructors. Gift voucher holders are also required to register online to book an appointment.

By making a purchase, the Consumer declares that he/she accepts the terms and conditions of these GTC and the Privacy Policy published on the website, and consents to the data processing as set out in the Privacy Policy.

The language of the contract is Hungarian. This document does not constitute a written contract, its contents are not filed and archived, and therefore it is not accessible or retrievable.

Prices are in HUF and include VAT.

The Customer shall pay the nominal value of the service used to Réka Petrányi e.v.

Purchases can be made in person at Fluss Yoga Studios by cash and by bank transfer. "Purchases" made by phone, fax, e-mail, letter are not accepted by Fluss Yoga Studios.

Our classes and courses are primarily for adults, children under 18 years of age are only allowed to participate with parental consent and/or supervision.

SUP boards at lessons and events are only available to Consumers with swimming knowledge and water safety.

Unfortunately, we cannot be held responsible for items stored by the Consumer.

Online credit card payments are made through the Barion system. Credit card details are not passed to the merchant. The service provider Barion Payment Zrt. is an institution supervised by the National Bank of Hungary, licence number H-EN-I-1064/2013.

In the comment field of each transfer, please indicate the name of the person who will be attending the course or workshop and the exact name of the course or workshop. The transfer invoice will either be sent by email to the email address provided on the day of registration or handed to you in person.

 

• Policies of the Fluss Studios

 

• Yoga classes always start on time. Please be considerate of others, so please never be late to class, especially not at the beginning of class to get in the mood! If you are late, wait quietly and join the practice at the instructor's signal.
• In and around the studio, we keep the studio quiet. Please do not disturb yoga classes with loud conversations in the environment! If you bring your own SUP board to class, we ask that you do not disturb the class in progress by inflating and deflating it with sound effects. During yoga classes, your focus should be on your inward focus.
• Yoga class is all about you, all about you. PLEASE DO NOT BRING YOUR CELL PHONE TO CLASS! There is no room for the outside world in yoga class, including your cell phone. Please either leave it outside the class or bring it into the class with it turned off.
• We like order. Please help us keep things tidy by putting yoga equipment back in its place after class (yoga mats disinfected and rolled up tight, blankets folded, cups on tray, slippers in place, SUP boards wiped down in storage...etc). The use of all other equipment (music player, air conditioning, heating...) is the responsibility of the instructor.
• Found objects are kept for a few months, but our storage options are limited. If they are not claimed, they will be donated to various charities.
• Let's protect our planet. Please do not litter.
• In view of the epidemic situation, if you feel sick, have a cough or a fever, please join at another time for the sake of your fellow practitioners!

• Use of day tickets, season tickets

 

• The validity and price of Season Tickets/Daily Tickets are available at  www.fluss.hu can be found on the "Prices" page.
• The Passes are offered to Consumers in several categories. To find out about the current categories and their detailed content before you buy, please contact  www.fluss.hu for more information. 
• The data may vary by type of season ticket.
• Passes are non-transferable once purchased.
• Passes are valid from the first use.
• The contract between the Parties shall terminate upon the use of the units available on the Lease or upon expiry of the period of use.
• The Service Provider shall not be obliged to refund the price of the day tickets/passes to the Consumer in case of a change in the Consumer's life or health condition.
• The Service Provider processes the data of the visitors of the yoga studio (Consumers) in accordance with the terms and conditions set out in the Privacy Policy, which can also be found on its website.

 

• The schedule of yoga classes

 

• The Consumer's participation in a yoga class is subject to www.fluss.hu online registration via the website.
• By providing the e-mail address included in the registration, the Consumer agrees to be notified by e-mail by our yoga studio of any changes related to the class and by providing the e-mail address, the Consumer automatically subscribes to our newsletter, which he/she can unsubscribe by clicking on the "Unsubscribe from newsletter" option at the bottom of the newsletter.
• The number of yoga classes is limited, so the Service Provider cannot guarantee the participation of the Consumer in the selected yoga class without prior registration.
• If the Consumer registers for a yoga class but is unable to attend, he/she has the possibility to cancel the class 24 hours before the start of the class in Motibro without any consequences. However, within 24 hours of the start of the yoga class, the system will validate one session of the pass.
• The yoga classes are 60/90 minutes long and  www.fluss.hu on the "Prices" and "Timetable" pages.
• The Service Provider will always start the yoga classes on time, therefore, in case of delay, the Service Provider cannot guarantee the Consumer's participation in the yoga class.
• Consumers use the services provided by the Service Provider at their own risk.
• The Service Provider is not liable for accidents caused by the Consumer's own fault or the fault of another Consumer. In all cases of accidents involving personal injury, a record will be made on the spot and signed by the instructor present and, if necessary, by any other person present on the course.

 

• Use of workshops

 

• Also for workshops/short courses, pre-registration is required in all cases, with a deposit or full payment, according to the details published when the course is advertised.
• In case of advance payment, the remaining course fees must be paid by the Consumer on the spot at the latest on the first occasion.
• The cancellation conditions:
  • In the event of cancellation 7 days before the start date of the workshop/short course, the Service Provider will refund the deposit to the Consumer.
  • In the event of cancellation 7 days before the start date of the workshop/short course, the Consumer will forfeit the deposit but will not be required to pay any further deposit.
  • In the event of cancellation on the day of the workshop/short course, the Consumer is obliged to pay the full fee to the Service Provider.
• If the workshop / or short course is cancelled by the Service Provider, the full amount paid will be refunded to the Consumer or can be used for other products or services provided by the Service Provider (e.g. for the purchase of season tickets, gift vouchers).
• Courses can be joined at the latest on the second occasion, but not after that.
• The Service Provider will process the data of the visitors of the workshops/short courses according to the terms and conditions set out in the Privacy Policy, which can also be found on its website.

 

• Use of yoga camps

 

• As with all yoga camps, pre-registration is required by paying a deposit or the full amount, according to the details published when the yoga camp is advertised.
• In the case of advance payment, the remaining course fees must be paid by the Consumer on the spot at the latest before the start of the yoga camp.
• The cancellation conditions:
  • In the event of cancellation 30 days before the start date of the yoga camp, the Service Provider will refund the advance payment to the Consumer.
  • In the event of cancellation 30 days before the start date of the yoga camp, the Consumer will forfeit the deposit, but will not be required to make any further payment.
  • In the event of cancellation on the first day of the yoga camp, the Consumer is obliged to pay the full fee to the Service Provider.
• In case the Service Provider cancels the credit card, the total amount paid will be returned to the Consumer or can be used for other products or services provided by the Service Provider (e.g. for the purchase of season tickets, gift vouchers).
• The Service Provider will process the data of the participants of the yoga camp in accordance with the terms and conditions set out in the Privacy Policy, which can also be found on its website.

• General rules for participation

 

• The possibility to participate in yoga classes and/or yoga courses provided by the Service Provider is open to anyone, subject to the following restrictions, in accordance with these General Terms and Conditions.
• Each Consumer participates in yoga classes and/or yoga courses provided by the Service Provider at his/her own risk, knowing his/her own health condition. The Service Provider shall not be liable for any injuries.
• The yoga instructor present and acting on behalf of the Service Provider is entitled to exclude from participation in a yoga class and/or yoga course / yoga camp in particular anyone who does not meet the basic hygiene requirements, i.e: his or her state of health or personal hygiene obviously endangers the health of the other participants in the sessions; intentionally or repeatedly violates the safety rules that are mandatory in the yoga studio and that were communicated prior to the course; endangers the physical safety of himself or herself or other participants in the sessions by his or her behaviour, either intentionally or through gross negligence; violates the basic ethical rules of social cooperation by his or her behaviour intentionally hinders or prevents the course of the sessions.
• The Service Provider reserves the right to deny the participant the possibility to register for further sessions in advance if the participant has been excluded from participating in a yoga class and/or yoga course due to the above.
• The Service Provider reserves the right to deny the possibility to register for further sessions and to refuse the sale of tickets/passes in advance if the participant repeatedly fails to comply with the rules of the house rules.
• Participants shall be entitled to use the yoga room, its equipment and the equipment provided solely for the purposes and in accordance with the provisions of this contract and shall be liable for any damage caused to them in connection with their conduct.

 

• Other provisions

 

• A www.fluss.hu website or any part of its content is protected by copyright. Only the Service Provider is entitled to exercise the rights thereto.

• Fluss/ Petrányi Réka e.v. is prohibited from using, reproducing, transferring, distributing, adapting or storing all or part of the content of this website in any form without the prior written permission of Fluss/ Petrányi Réka e.v.
• Fluss/ Petrányi Réka e.v. is entitled to send newsletters to the Consumer if the Consumer has given his/her prior, unambiguous, explicit and voluntary consent by providing the relevant data and accepting the Privacy Policy. The subscriber may request to be removed from the list of subscribers to the newsletter at any time. You can unsubscribe from the newsletter by letter, email or by using the "Unsubscribe" link at the bottom of the newsletter.
• Fluss/ Petrányi Réka e.v. is not obliged to verify whether the data provided by the Consumer at the time of giving consent are true or correct.

• Consumer complaints can be made in writing to [email protected].
• Fluss/ Réka Petrányi e.v. may initiate the procedure of a conciliation body for the simple, quick, out-of-court settlement of disputes (consumer disputes) arising against Fluss/ Réka Petrányi e.v.
• In matters not covered by these general terms and conditions, the provisions of Act V of 2013 on the Civil Code and Government Decree 45/2014 (II.26) on the detailed rules of contracts between consumers and businesses shall apply.
• These general terms and conditions shall apply to the Consumer as in force at the time of purchase.
• VIS MAIOR: if Fluss/ Petrányi Réka e.v. is unable to fulfil its obligations related to the provision of the Service for reasons beyond its control and for which it is not responsible, this shall not constitute a breach of contract. Such a situation, known as force majeure, is in particular war, civil uprising, strike, riot, natural disaster, fire, explosion, interruption of electricity supply, failure or interruption of leased line service, state of emergency, epidemic situation or any other similar unavoidable situation). In the event of force majeure, Samadhi Yoga Studio/Samadhi Yoga Studio Ltd. shall be relieved from liability for non-performance or partial non-performance of its obligations only to the extent and for such period as the force majeure materially prevents or renders impossible performance to the extent and for such period as the force majeure prevents performance.
• Fluss/ Petrányi Réka e.v. has the right to unilaterally modify the offer, layout and menu system of its website.
• Fluss/ Petrányi Réka e.v. may unilaterally modify the terms and conditions of these GTC at any time.
• Valid from 27 March 2017 until revoked and/or amended. Its provisions shall apply only to contracts concluded after its entry into force.
